Service Animals at your RV ParkWe recently received a call from a client of ours who had a potential customer at their park who was going to camp in their tent spots. The park owner looked out and saw the customer had two dogs in the vehicle and informed the customer that pets were not allowed into the tent sites.
The client informed the owner that these were “Service Animals” and when the park owner asked for certification or identification, the guest became agitated and stated, “You can’t legally ask me that for that!”
Concerned, the client called us to ask what their responsibilities were for insurance. While your standard General Liability provides coverage for only bodily injury and property damage, the question made me curious. So I did some research at the US Department of Justice Civil Rights Division website www.ada.gov and found out more on the topic.
Under the Americans With Disabilities Act (ADA), privately owned businesses that serve the general public are prohibited from Discriminating against individuals with disabilities. ADA requires that such businesses allow people with disabilities to bring their service animals onto business premises in whatever areas customers are generally allowed.
Well, what is a service animal? According to the website, a service animal is any guide dog, signal dog or other animal individually trained to provide assistance to a person with a disability. If they meet this definition, they are considered service animals regardless if they have been licensed or certified with the state or local government.
I’m not sure if the person is disabled or what service the animal provides. What am I allowed to ask? You can ask two basic questions under the Act: 1) is the service animal required because of a disability and 2) what work or task has the dog been trained to perform? Your staff cannot ask about the person’s disability, require any sort of documentation or identification or even ask that the animal demonstrate its ability to perform the work or task.
When can I ask them to remove the service animal from my premises? In only two instances: 1) the animal is out of control and the handler does not take effective action to control it or 2) the animal is not housebroken. Control does not mean that the dog must be on a leash if the individual’s disability prevents using those devices, then it must be controlled through voice or signal.
I have a restaurant and the state health inspector prohibits animals from entering my premises unless it’s a “guide dog”, if I follow those regulations am I violating the ADA? Yes. Federal laws take priority over state or local laws and regulations.
I have allergies. Can I exclude a service animal because of allergies, or charge a cleaning fee? No. You must provide the same services for the same cost as you would for the general public. If you do charge a post visit cleaning fee to the rest of your guests, then you may charge it to the guest with the disability as well.
This was intended as a brief article about the ADA regulations regarding service animals and not a comprehensive guide. The ADA website answers more questions in detail. What I really learned is that even if you have suspicions about whether it’s a service animal or not, it’s best to err on the side of caution as the website was also filled with examples where business owners lost court cases over service animal access.

Kalispell Fire Department awarded $5,000 grantLeavitt Recreation & Hospitality Announce Fireman’s Fund Grant Winner
Sturgis, SD (date) – Leavitt Recreation and Hospitality Insurance (LRHI) is proud to announce the Evergreen Volunteer Fire Department of Kalispell, Montana, as the winner of a $5,000 grant funded by the Fireman’s Fund Insurance Company Heritage Program. The fire department was nominated by Rocky Mountain Hi RV Park and Campground of Montana.
Fireman's Fund, in partnership with LRHI, recently asked RV Park and Campground owners to nominate their local fire departments for this grant. Nominees were entered into a random drawing. As this year’s winner, Evergreen Volunteer Fire Department can use the money for needed equipment, firefighter training, and community education programs.
"We had a lot of positive feedback at industry conventions about this program,” said Chris Hipple, vice president of LRHI. “We were very pleased with how many people sought us out and took the time to register for the benefit of their local fire department.”
Last year a $10,000 grant was awarded to Crisp County Fire Department in Georgia through the LRHI drawing. Fireman's Fund has awarded over $7,000,000 in grants nationwide through their employees and independent agents.

Fireman's Fund and LRHI award $5,000 grantRocky Mountain Hi RV Park and Campground of Montana was selected as the winning park to award their local fire department a $5,000 grant through the Fireman's Fund Insurance Company Heritage Program. The fire department nominated by Rocky Mountain Hi was the Evergreen Volunteer Fire Department of Kalispell, Montana which has 36 volunteers.
Fireman's Fund, in partnership with Leavitt Recreation and Hospitality Insurance, recently asked members of the RV Park and Campground industry to nominate their local fire departments for this grant.
The response was very good, according to LRHI Vice President, Chris Hipple, "We had a lot of people at both the KOA and national ARVC convention comment on how this was such a good program for the fire departments and they wanted to help. People were lined up to enter their fire department."
Entries were not limited to customers of LRHI or Fireman's Fund and there was even opportunity to enter online. "Once we got the news up on Facebook, Twitter and even Firehouse.com, the online entries pretty much exploded. We were very pleased with how many people sought us out and took the time to register for the benefit of their local fire department," Hipple said.

LRHI Announces New Program UnderwriterLeavitt Recreation & Hospitality Insurance (LRHI) is pleased to announce Mitch Burdick as the new program underwriter for their RV park and campground program.
Burdick has been with the agency since 2006 and is a Certified Insurance Service Representative (CISR). Prior to LRHI he worked in credit collections, financial services, and real estate. “I am excited for this new opportunity,” said Burdick. “My past experience has given me a strong understanding of risk analysis and risk management.”

The program is through Fireman’s Fund Insurance Company and Penn America, both rated “A” with industry ratings expert A.M. Best. The program overcomes many of the traditional barriers to writing these risks.

RV Park and Campground Program Now AvailableLeavitt Recreation & Hospitality Insurance (LRHI) announces that their RV park and campground program is now available on a general agency basis. Chris Hipple, vice president of the agency, heads the previously exclusive program.
“Our program has been growing successfully, and we feel it is ready to offer to outside agents,” said Hipple. “It provides a partnership with agents who have relationships with RV parks and campgrounds but have been unable to find the coverage to fit their needs.”
